Terms of Service

These Terms are original plain-English terms for Petal9, Vybrr, AI Petal, florist storefront tools, user accounts, messaging, flower ordering, subscriptions, and community features. They are prepared for platform readiness and future attorney review.

1. Introduction

Petal9 and Vybrr help people connect, build communities, discover relationships, support florists, and grow businesses through flower gifting, private social features, AI-powered recommendations, and storefront tools.

These Terms govern your access to and use of Petal9, Vybrr, AI Petal, our websites, applications, services, software, storefront tools, messaging features, flower ordering tools, and related features.

By using the services, you agree to these Terms. If you do not agree, you should not use Petal9, Vybrr, AI Petal, or related services.

2. Private Subscription-Based Platform

Petal9 and Vybrr are not ad-funded social media platforms.

Users, florists, businesses, or subscribers may be charged for certain features, subscriptions, storefront tools, AI Petal features, communication tools, flower ordering services, or premium services.

Billing cycles, cancellation rules, renewal terms, and refund terms may appear at checkout, in account settings, or in the Refund Policy.

3. No Sale of Personal Data

Petal9 and Vybrr do not sell personal data to advertisers, data brokers, or third-party ad networks.

Personally identifying information such as name, email address, billing information, private messages, profile details, contact information, and delivery information will not be shared with advertisers unless you give permission or the law requires it.

4. Accounts and Eligibility

You must provide accurate account information and keep it reasonably up to date.

You are responsible for keeping your login credentials secure and for activity that occurs through your account.

Vybrr is only for users 18 years of age or older.

You may not create fake accounts, impersonate another person or business, misuse the services, attempt to bypass security controls, or access another user's account without permission.

5. User Conduct

Users must treat others respectfully.

Harassment, hate speech, threats, exploitation, scams, spam, fraud, illegal activity, sexually exploitative content, unsafe behavior, and attempts to misuse flower-sending or messaging features are prohibited.

Violations may result in account restriction, content removal, subscription limitation, suspension, or termination.

Reports may be routed to the Petal9 Super Admin for review and safety action.

6. Vybrr Messaging and Community Features

Vybrr may include profiles, interests, matches, communities, messaging, reporting tools, blocking tools, and flower-sending features.

You are responsible for the content you post, send, upload, or share.

Do not share private information you do not want others to see. Vybrr is private from the public web, but content may still be visible to intended recipients, matched users, members where applicable, moderators, admins, or support staff when needed.

Safety tools, reports, blocks, account restrictions, and moderation actions may be used to protect users and the platform.

7. Send Flowers and Private Address Consent

Vybrr users may send flower requests through Petal9.

The recipient must accept the flower request before entering a delivery address.

The sender should not see the recipient's private address.

Delivery information should only be used to complete the flower order, support delivery, prevent fraud, resolve disputes, and maintain required business records.

You may not misuse the flower-sending feature to harass, pressure, locate, track, intimidate, or otherwise harm another person.

8. Petal9 Florist Services

Florists may create accounts, apply for storefront access, manage business profiles, list products, receive orders, use storefront tools, and participate in subscription tiers.

Florists may be required to provide business information, license details, payment details, tax information, identity details, or other verification information.

Petal9 may approve, reject, suspend, remove, or limit florist accounts that violate platform rules, fail verification, create safety concerns, or do not meet business requirements.

Florists are responsible for accurate product information, pricing, delivery availability, order fulfillment, customer service, refunds or substitutions where applicable, and compliance with applicable business, tax, floral, delivery, and consumer protection laws.

9. AI Petal

AI Petal may generate floral recommendations, arrangement ideas, product suggestions, images, descriptions, card message ideas, florist matches, or related outputs.

AI outputs may not always be perfect, available, accurate, complete, or guaranteed.

Users and florists should review AI-generated content before relying on it, publishing it, sending it, or using it for a transaction.

Petal9 is not responsible for user misuse of AI-generated content.

10. Payments, Subscriptions, and Refunds

Some features may require payment.

Payments may be processed by third-party payment providers such as Stripe, PayPal, Apple, Google, or other payment processors.

Petal9 and Vybrr should not store full credit card numbers, CVV codes, or full payment credentials on their own servers.

Subscription fees may renew automatically unless canceled according to the applicable subscription terms.

Refund eligibility follows the Refund Policy and any terms shown at checkout.

11. Privacy

The Privacy Policy explains what data we may collect, how we may use it, how it may be protected, how it may be shared to provide the services, and how users can request account deletion or data deletion.

By using Petal9 or Vybrr, you acknowledge that data practices are described in the Privacy Policy.

12. Content Ownership

Users keep ownership of content they create or upload.

By posting, sending, or uploading content, you grant Petal9 and Vybrr a limited license to host, display, process, transmit, store, moderate, and operate that content only as needed to provide, protect, improve, and support the services.

You must have the rights to anything you upload, send, or share, including images, text, business materials, product descriptions, profile content, and messages.

13. Platform Changes and Availability

Petal9 and Vybrr may update, modify, suspend, limit, or discontinue features, subscriptions, storefront tools, AI features, or services.

Services may occasionally be unavailable due to maintenance, bugs, outages, security issues, emergencies, traffic spikes, or failures by third-party providers.

Petal9 and Vybrr do not guarantee uninterrupted, secure, or error-free service.

14. Account Suspension and Termination

Petal9 and Vybrr may restrict, suspend, or terminate accounts that violate these Terms, Community Guidelines, the Safety Policy, payment rules, florist requirements, or applicable law.

Users may request account deletion through the Delete Account page or support process.

Some information may be retained when needed for safety, fraud prevention, payment disputes, taxes, legal compliance, business records, backups, or enforcement of these Terms.

15. Disclaimers and Limitation of Liability

The services are provided as available.

Petal9 and Vybrr do not guarantee matches, relationships, community outcomes, business revenue, florist sales, delivery outcomes, inventory availability, AI accuracy, uninterrupted access, or that every issue will be resolved in a particular way.

To the fullest extent allowed by law, Petal9, Vybrr, and their owners, employees, contractors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost business, missed connections, failed deliveries caused by third parties, or unauthorized user conduct.

Where liability cannot be excluded, our liability will be limited to the amount you paid for the specific service giving rise to the claim, unless applicable law requires a different result.

16. Updates to the Terms

Petal9 and Vybrr may update these Terms from time to time.

We should notify users of major changes when appropriate, such as through the app, website, email, or account notice.

Continued use of the services after updated Terms become effective means you accept the updated Terms.
